These Terms of Service ("Terms", "Agreement") govern your rental of premium hair extensions, hairpieces, and related accessories (collectively, "Products") from our platform. By placing an order, checking the "I Agree to the Terms & Conditions" box at checkout, or utilizing our services, you ("User", "Customer", "You") agree to be bound legally by this Agreement. If you do not agree, please do not use our rental services.

1. Eligibility & Account Registration

• 1.1 Age Requirement: To rent Products from Hairshare.in, you must be at least 18 years of age and possess a valid credit card, debit card, or UPI account issued by a bank acceptable to us.
• 1.2 Identity Verification: We reserve the right to request a valid Government-issued ID (e.g., Aadhaar, PAN, Driving License) or social media profile verification prior to processing your order to mitigate fraud and protect our inventory.

2. Order Fees, Billing, & Tax Structure

When you place a rental order, your total payment will be clearly split into two distinct components:

• 2.1 The Rental Fee: This is the non-refundable fee charged for the time-bound use of the Product.
  Taxation: In accordance with Section 9 of the CGST Act (under SAC Code 9973 for leasing/rental services), the Rental Fee is subject to Goods and Services Tax (GST) at the prevailing rate of 18%. This tax is calculated and displayed transparently on your Tax Invoice at checkout.
• 2.2 The Security Deposit: A fully refundable, interest-free security deposit is collected for every rental item to protect against damage, non-return, or loss.
  Taxation: Under Section 2(31) of the CGST Act, a purely refundable deposit is not treated as consideration for supply. Therefore, 0% GST is applied to the deposit at checkout. It is not revenue and is held in trust until the Product is returned and inspected.

3. The Quality Check (QC) & Refund Process

• 3.1 Return Window: The rental period begins when the carrier marks the package as "Delivered" and ends on the designated return date. The Product must be handed over to our logistical partner on or before the return date.
• 3.2 Inspection Timeline: Upon receipt of the returned Product at fulfillment center, our team will conduct a thorough Quality Check (QC) within 48 to 72 business hours.
• 3.3 Processing the Refund: If the Product passes the QC inspection (Normal Wear and Tear accepted, as defined in Section 4), the Security Deposit will be released in full. Refunds will be executed via our payment gateway partner directly to the original payment method used at checkout. Depending on your banking institution, funds may take 3 to 7 business days to reflect in your account after release. We do not issue cash refunds or transfers to third-party bank accounts.

4. Product Care, Damage, & Forfeiture Guidelines

While we want you to feel confident and look stunning, hair is a sensitive product that requires strict adherence to care guidelines.

• 4.1 Normal Wear and Tear: "Normal Wear and Tear" refers to minor tangling that occurs naturally during use or slight loosening of clips. This will not impact your deposit.
• 4.2 Prohibited Actions: You strictly agree NOT to perform any of the following actions on our Products:
  • Cutting, trimming, or reshaping the hair or wefts.
  • Dyeing, bleaching, toning, or applying any chemical color/perming treatments.
  • Applying excessive heat exceeding 180°C. High-heat tools can instantly singe, melt, or permanently degrade human and synthetic blend hair.
  • Washing the hair with unapproved, harsh sulfates or stripping agents.
• 4.3 Damage & Forfeiture Schedule: If a product is returned damaged, a deduction will be made from your Security Deposit based on the severity of the damage:

• 4.4 Tax on Forfeited Deposits: In compliance with CBIC Circular No. 178/10/2022-GST, the moment a security deposit or part thereof is forfeited due to damage or non-performance, it ceases to be a deposit and becomes liquid damages ("consideration for tolerating an act"). Therefore, any amount deducted or forfeited from your deposit will be treated as inclusive of 18% GST, and a supplemental Tax Invoice/Debit Note will be issued to you for your records.

5. Hygiene, Sanitization, & Health Disclaimer

• 5.1 Medical-Grade Hygiene: Hairshare.in guarantees that every Product undergoes an intensive, multi-step, clinical-grade washing and sterilization process prior to being sealed and shipped. We guarantee zero skin or scalp contact with unwashed elements from previous renters.
• 5.2 User Responsibility: You agree to wear the extensions on a clean, dry scalp. Hairshare.in is not liable for any individual allergic reactions to clips, adhesives, or specialized cleaning agents used in our sanitization cycle.

6. Limitation of Liability & Governing Law

• 6.1 Limitation of Liability: To the maximum extent permitted by law, Hairshare.in, its directors, and employees shall not be liable for any indirect, incidental, or consequential damages resulting from the use, inability to use, or performance of our Products.
• 6.2 Jurisdiction: These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these rental services shall be subject to the exclusive jurisdiction of the courts located in Delhi-NCR.
